What Is Considered DUI in South Carolina?

In South Carolina, someone can be charged with DUI when they operate a motor vehicle while under the influence of alcohol, drugs, or a combination of substances. The state's law provides two primary ways for a person to be charged. The first is if a person's blood alcohol concentration (BAC) is at or above the legal limit, which is 0.08% for most drivers. For drivers under 21, the legal limit is 0.02%, and for commercial drivers, it's 0.04%.

Alternatively, a person can still face DUI charges even if their BAC is below the legal limit if their faculties to drive are "materially and appreciably impaired" by alcohol or drugs. This means that a law enforcement officer can use other evidence, such as observations of your driving, your performance on field sobriety tests, or physical signs of impairment, to charge you with DUI.

Can I Refuse a Breathalyzer Test in South Carolina?

You do have the option to refuse a breathalyzer test, or any chemical test designed to measure your BAC in South Carolina, but that refusal comes with consequences. South Carolina's implied consent law states that by driving on the state's public roads, you automatically consent to a breath, blood, or urine test if a law enforcement officer lawfully arrests you for DUI. While police cannot physically force you to take a test, refusing it will trigger immediate and separate punishments.

There are penalties for refusing a BAC test. A refusal results in an automatic suspension of your driver's license for six months for a first offense, even if you are not ultimately convicted of DUI. If you have prior alcohol-related convictions or suspensions, the length of the suspension increases. Additionally, a prosecutor can use your refusal as evidence against you in court, arguing that you refused because you knew you were impaired.
