What Constitutes Theft in South Carolina?

Theft or larceny is defined as taking someone else's property without consent and with the intent to permanently deprive the owner (S.C. Code § 16-13-30). This may include personal property, money, or other physical items.

What Are Common Theft Crimes in South Carolina?

Petit Theft

Petit theft or simple larceny involves stealing property valued at less than $2,000  (§ 16-13-30(A)). First offenses are generally misdemeanors punishable by short-term jail sentences and fines. 

Grand Larceny

Grand larceny occurs when the value of the stolen property exceeds $2,000 (§ 16-13-30(B)). This felony offense carries harsher penalties, including fines and prison sentences.

Larceny by Trick

Obtaining signature or property by false pretenses or “larceny by trick” occurs when a person intentionally misrepresents a fact or situation to convince someone to transfer property (§ 16-13-240). Unlike petit theft, larceny by trick involves the key element of fraudulent intent. 

Shoplifting

Shoplifting involves taking merchandise from a retail store without paying or altering price tags or labels (§ 16-13-110). This offense can be charged as a felony or a misdemeanor, depending on whether the value of the items exceeds $2,000. Repeated or high-value shoplifting may result in felony charges.

Organized Retail Crime

Organized retail crime involves coordinated efforts to steal large quantities of merchandise or conduct thefts for resale or profit (§ 16-13-135). These are serious cases that often result in felony charges with substantial penalties.
